Legal FAQs — New York

Frequently Asked Questions

We are dedicated to providing the clarity you need to remove any uncertainty that you’re feeling during the legal process. The best way to have a clear understanding of your situation is to contact our office and speak directly to an experienced attorney. We have also provided a few questions and answers here.

Will my case be handled by an experienced attorney?

Yes. Gary Mitchel Gash, the senior partner, aggressively advances each case to achieve the desired results. He supervises each stage of the litigation process, from deposition to trial, carefully reviewing the pertinent facts and law in order to develop a successful case strategy. Should your case not resolve itself in a satisfactory settlement, in most instances Mr. Gash will personally take your case to trial. We never reassign cases to less experienced attorneys. If there are interim issues during the litigation or after verdict that require appellate review, we have associated ourselves with distinguished and well credentialed appellate counsel.

Will my case be overwhelmed by larger cases in the office?

No. As previously stated, by limiting the number of cases we represent, we can bring to the representation of all of our clients the same zeal and enthusiasm. It does not matter whether you are an individual who suffered injuries in a slip, trip and fall, or a corporation involved in complex commercial litigation. No client’s matter is less important than any other client’s matter in our office. We know how important your case is to you and to your family, and we handle it as if it were the single most important case in our practice.

How do I pay my legal fees?

On personal injury cases we take cases on a contingency fee basis. This means that if there is no monetary recovery, you owe us nothing for our services. For other types of cases, the firm is paid on an hourly basis for the attorney’s time spent on the matter.

How do I pay for the expenses of the case?

The law requires that the client advance expenses and be personally responsible for them, however, in personal injury cases should you be unable to afford the expenses Gash & Associates, P.C. will advance the expenses of the case and we will be paid back by you at the end of the case, usually from the recovery.

How do you decide whether you will take my case?

We look at many cases and, unfortunately, we are not able to help all the people who ask for and need our help. We give consideration to all cases and if we believe that we can be of service to you, we will take the case. Sometimes, if we are unable to help you, we know of other lawyers who can help, and we will refer you to them.

How much is my case worth?

The value of each case is different and must be evaluated separately. We take a great deal of time to come to a proper evaluation of your case. However, you must know that there is never a guarantee of any recovery.

How long will it take before we go to trial?

We work in the tri-state area and in the various counties of New York State. Each court differs in the amount of time it takes to bring a case to trial. Once we know what court we are in we are in a much better position to estimate the time to trial.

Will you speak with me before settling my case?

Yes, no case is ever settled without your consent. Whenever settlement negotiations are initiated you will be informed, and it is only with your full participation, advice, and consent, that your case will be settled.
